Deducting 25% salary of teachers 'Fixed Pay' for 5 years is unconstitutional :Tripura High Court

The Tripura High Court today dismissed the 'bond' of the fixed pay policy of 2001 and 2007, which deducted 25% of the salary of teaching staff every month for 5 years, as unconstitutional.

This case ( 74 & 75 of 2025 ) concerns the salary of teachers appointed to the posts of Graduate Teacher (IX-X) and Post Graduate Teacher (XI-XII) in the state of Tripura. Although the teachers were appointed to permanent posts in 2017-18, the government was paying them fixed pay (75% of salary) for 5 years.

The claim is based on the teachers:

They have been elected to regular and permanent positions, in accordance with the rules.
Despite having the same job and the same qualifications, other teachers are receiving regular salaries, but they are not.
This is a violation of the principle of "equal pay for equal work".

Final orders of the court:-

Memorandum regarding Fixed Pay of 2001 and 2007 is cancelled.
Teachers are considered regular teachers from the first day of appointment.
Regular salary (notional) will be calculated from the date of appointment.
However, actual arrears will be paid up to 3 years prior to filing the writ.
9% interest will be charged on the outstanding amount.

The money must be paid within 3 months.
